Upon entry into force, almost ten years ago (September 2004) of Law 22/2003, Bankruptcy, we conclude that one of the objectives pursued, which was the continuity of business in companies in crisis, is far from being achieved. About 95% of the entities that are subject to insolvency proceedings are pushed to extinction.
The magnitude of the crisis has made inoperative many of the precepts contained in the Bankruptcy Act. The legislature, by successive reforms, and the courts, through a flexible and practical interpretation of legislation have attempted to provide greater agility to processes designed to safeguard business continuity and maintenance jobs.
In this sense becomes increasingly hard figure sale of the production unit, within the different modalities allowing bankruptcy regulations.
The purpose of this Day, organized by the Chamber of Commerce and Industry of Madrid and dispatch "Rock Junyent" in collaboration with the Association of Economists of Madrid, CISM Business Confederation of Madrid-CEOE, and Thomson Reuters, is to to meet entrepreneurs, professionals and potential investors, the figure of the sale of production unit based in bankruptcy, analyzing from an eminently practical to its enormous advantages when implementing potential investments in companies in crisis, without forgetting their limitations and uncertainties.
